Road passenger carrier StarWays (STARWAYS SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, ul. Energetyków 23-25A, lok. 101, 20-468 Lublin, Poland, NIP: 7011098940, REGON: 522689032) has established standard rules and conditions for the carriage of passengers and their baggage, which form the terms of the carriage agreement (the ticket):
The passenger must arrive for boarding no later than 30 minutes before the bus departs. The passenger is responsible if they are late for boarding. Smoking, consuming alcohol or drugs, playing music or watching video without personal listening devices (headphones), littering, speaking loudly, or otherwise disturbing the peace of passengers and the bus crew is prohibited in the cabin and lavatory of the bus while underway. If these requirements are not met, StarWays reserves the right to remove the passenger from the trip without financial compensation. The bus crew may refuse to carry a passenger if:
The road passenger carriage agreement may be terminated at the initiative of StarWays or the bus crew if the Passenger:
If these requirements are not met, StarWays reserves the right to terminate the agreement without financial compensation.
The passenger is liable for material damage they cause to StarWays. Children and young people under 16 may only travel accompanied by adults. Other categories of persons are subject to the applicable rules of the countries through which the travel route passes.
StarWays is not liable to the passenger for the correctness of the completion or the availability of documents that give the right to cross the borders of the countries on the route.
StarWays is not competent to give advice and explanations regarding border-crossing rules, items prohibited and permitted for carriage, amounts of money, intellectual property objects, etc. StarWays provides carriage exclusively.
StarWays is not liable for a passenger’s violation of customs or immigration rules.
If a Passenger violates visa regimes (visa expiry, replacement of a passport with another document, etc.), StarWays reserves the right not to carry the passenger, and the carriage agreement is considered terminated early. The ticket price is not refunded.
If a Passenger fails to comply with customs and border rules and is detained at the border, and this causes a delay of the trip of more than 30 minutes, the bus crew has the right to depart from the border without the passenger, in accordance with the bus schedule and without compensation for the ticket price. The passenger must compensate StarWays for any damages arising from the passenger’s violation of customs, migration and border rules, including any related sanctions against StarWays.
StarWays is not liable for delays en route and untimely arrival at stops if caused by circumstances beyond its control (including delays while crossing borders, weather conditions, traffic jams, actions of government authorities, road repair works, etc., actions of the passengers themselves that affected these circumstances) and other reasons (technical problems with the bus while underway, which could not have been prevented by the carrier despite all precautions taken). The time spent waiting in a queue at the border is included in the border-crossing delay time.
The ticket is a personalized travel document for bus travel and cannot be transferred to another person; it is valid until the date and time of departure indicated on the ticket, provided the passenger complies with these Rules. When boarding, you must have a printed ticket or show an electronic ticket showing all the carriage information, along with an identity document (e.g. passport, birth certificate, etc.) and a document confirming eligibility for a discount (for passengers using a discount). Changing the date of a trip is a paid service, the cost of which is determined according to StarWays’ current tariffs.
A refund for an unused trip will be made on the terms defined by the Offer Agreement. Funds are not refunded when returning baggage receipts to their holders.
In accordance with generally binding legal norms and rules, baggage carried separately from the passenger in the luggage compartment is considered “baggage”, while baggage carried in the bus cabin and kept under the passenger’s supervision is considered “hand luggage”. For each item of baggage the passenger may be issued a baggage receipt, which states the value of the baggage as declared by the passenger and is certified by a StarWays representative.
Baggage or its contents may not be items whose nature and properties could damage the bus, cause harm to the life or health of people or their property, nor bulky items (regardless of the amount of baggage), if the baggage is carried separately from the passenger.
An item that cannot be baggage or part of its contents is defined as: any weapon, explosive, toxic, radioactive, flammable or aggressive substances that may cause infection, or an item weighing more than 25 kg that cannot fit in the bus’s luggage compartment.
Baggage handed over is carried in the bus’s luggage compartment and may be identified by a baggage receipt.
Within the price of the ticket, the passenger has the right to carry one piece of hand luggage with dimensions of 20×30×40 cm. Other baggage may be carried for a separate fee and only if there is free space in the bus’s luggage compartment.
If these weight and size limits are exceeded, an additional baggage fee may be charged. Additional baggage is carried subject to available space in the bus’s luggage compartment, for which a fee is charged. Additional baggage must not exceed the size and weight of the main baggage. Oversized baggage (refrigerators or similar) is not carried.
If it is not possible to carry baggage due to its physical characteristics (large weight, dimensions) and the passenger refuses the trip for this reason, the consequences of a voluntary ticket return and the rules for refunding money paid for the carriage of such a passenger’s baggage will apply.
Hand luggage must be placed in the bus in such a way (following the driver’s instructions or those of another authorized person) that it does not endanger the safety or interests of other passengers.
StarWays is not liable for hand luggage. The carrier is liable for baggage destroyed or damaged in the bus’s luggage compartment only if this occurred through the carrier’s fault, as proven by the passenger, but not exceeding a total amount of 200 Euros per person, provided a claim is submitted no later than 10 days from the date of the bus’s departure.
It is prohibited to carry baggage that endangers the safety or health of other passengers. The carrier is not liable for a passenger’s loss of money, jewellery, passport, securities, collectible items, items of scientific value and other valuables that are not located in the bus’s luggage compartment. The passenger is personally responsible for the legality of their own baggage. In the event of complications at the border, the carrier has the right to refuse to fulfil its obligations regarding the carriage of baggage and continue the trip without the specified baggage.
When transferring, the passenger is personally responsible for transferring all of their baggage to the bus in which they will continue their trip.
Baggage is considered to have been lawfully issued when it is handed to the holder of the baggage receipt after payment of storage fees, if any. Without a baggage receipt provided, the carrier is obliged to issue the baggage to a person who proves their right to it. Unclaimed baggage is stored in a safe and convenient place at the passenger’s expense for up to 30 days. After this time, the baggage is considered irretrievably destroyed without any obligations for StarWays. StarWays will draw up a report on the destruction.
The Company may charge a fee of 5 Euros for baggage storage per day. The first day of storage is considered to be the day following the completion of the trip. If the characteristics of the baggage require additional costs for special storage, such costs must be additionally compensated by the owner of the baggage before it is received.
If the passenger accepts the baggage without objection, the baggage is considered to have been handed over in good condition and in full, unless proven otherwise. If baggage is lost, or if upon accepting the baggage the passenger discovers visible damage, incompleteness or circumstances indicating this, the passenger must immediately notify a StarWays employee, who must draw up a report on the condition of the baggage. This report, together with the ticket and the baggage receipt, forms an integral part of a claim, which must be made in writing.
StarWays is not liable for damage caused during the carriage of baggage if the loss, damage or delayed delivery of the baggage was caused by the following reasons:
Additional services (in particular, the provision of hot drinks, light snacks, newspapers, magazines, watching films, Wi-Fi, internet access, toilet, air conditioning) are provided as an addition to the carriage agreement, based on the carrier’s momentary capabilities, and their absence does not give the passenger the right to compensation.
The passenger is required to be belted throughout the entire trip if their seat is fitted with a seatbelt.
Each passenger has the right to only one seat. In the case of the purchase of two or more seats, they have the right to the corresponding number of seats.
A passenger who interrupts their trip is not entitled to a refund of the fare.
Short stops (for hygiene needs or meals) during the trip are not mandatory. Their timing and duration depend on the route schedule. In the event of short stops during the trip, the passenger is required to return to the bus cabin before the end of the time specified by the driver or attendant. If the passenger does not return to the bus cabin within 5 minutes after the end of the established stop time, the passenger is considered to have refused to continue the trip and is not entitled to any compensation for the remainder of the trip.
The carriage of animals is prohibited, with the exception of guide dogs, with the relevant documents. In such a case the dog is carried at a separate rate, calculated based on the general ticket, and must have a designated place on the bus.
If the vehicle stops for operational reasons outside a station or at stations where there is no scheduled stop, passengers may disembark or board the bus only with the permission of the driver or another person authorized by the carrier.
When planning their trip, further transfers, etc., the passenger must take into account the possibility of delays. The carrier is not liable for losses arising as a result of a delay, cancellation of a trip, or delay of a subsequent trip, without clear fault on the part of the carrier.
Departure and arrival times in the schedules and tickets are always indicated in local time.
Compensation for the loss of or damage to baggage may not exceed the limits established by generally binding legal norms. If the value of the baggage exceeds 200 Euros, the passenger is advised to arrange additional baggage insurance.
StarWays is not liable for thefts that occurred in the bus cabin. This does not apply to cases where the bus was supposed to have been locked with no passengers inside.
